PAYMENTS AND SAFETY
Credit Card payments are made online safely with SSL-secured payment form provided by Stripe, Inc. Our online store uses the international Verified by Visa and MasterCard Secure code authentication services. Lomi Travels does not have access to cardholder data and card information is not stored in our systems. The domain where you enter and process your payment is owned and operated by LomiTravels.
GENERAL TERMS AND CONDITIONS
These Terms and Conditions govern the relationship between you and LomiTravels. By booking an activity, you agree to be bound by these Terms and Conditions. They affect your rights and designate the governing law and forum for the resolution of any and all disputes.
1. THE CONTRACT
Hereafter “customers” or “client” shall refer to the person or persons named in the booking including minors, and “agent” or “supplier” as any person, organization or company that sells LomiTravels services through an agreement with LomiTravels. All clients wishing to make a booking have carefully read and understand the Terms and Conditions, Cancellation Policy & Waiver with acknowledgement of risks that follow. By making a booking the client accepts to be bound by these Terms and Conditions. Nature Trips and all agents reserve the right to decline any booking. The service to be provided are the activities referred to in the booking confirmation.
2. TRAVELING WITH CHILDREN
The minimum age for clients attending LomiTravels activities varies according to each activity. It is the client’s responsibility to determine the minimum age requirements according to each activity before reserving / buying a trip from LomiTravels. Clients are recommended to consult LomiTravels before making their reservation. Children under 14 must be accompanied by an adult. An adult is defined as anyone over 18. All inquiries with respect to children are subject to review and approval by LomiTravels. LomiTravels reserves the right to restrict the number of travelers under the age of 18 on activities.
3. CREDIT CARD CHARGES
LomiTravels is not responsible for any charges applied to credit card transactions and will not refund or return any fees charged by third parties and incurred during the transaction of the trip cost.
4. CANCELLATION OF ACTIVITY BY THE CLIENT or AGENT
Customers and booking agents must notify LomiTravels of any cancellations. LomiTravels will not provide discounts or refunds for missed or unused services, whether voluntary or involuntary.
Any activity with LomiTravels can be changed or cancelled regarding the cancellation policy. If there is not a PDF file with the cancellation policy attached in the booked tour or activity, take note of the following fees:
0% (no) fee for cancellations more than 21 days prior to activity and if agreed together 0% (no) fee conditions for cancellations.
100% fee for all credit card payments or if the cancellation is done less than 3 days (72 hours) prior to activities or in case of no-show.
Gift Certificates or coupon tickets are non-refundable in all circumstances.
5. CANCELLATION OF ACTIVITY BY LomiTravels
LomiTravels reserves the right to cancel any activity for any reason, but will only cancel an activity less than 12 hours before departure for unusual or unforeseen circumstances outside LomiTravels control (Force Majeure) or if there are too few people to operate an activity. When LomiTravels cancels an activity, the client may choose between a full refund of all money paid or any alternative activity available and offered by LomiTravels. If the alternative activity is less costly than the original then LomiTravels will refund the difference. Similarly, if the alternative is more costly then the customer is obligated to pay the difference. LomiTravels is not responsible for any incidental expenses or consequential losses that the client may have incurred as a result of the booking.
6. FACTORS OUTSIDE LomiTravels CONTROL (FORCE MAJEURE)
LomiTravels endeavors to conduct its operations safely. However, LomiTravels is not liable to customers in the event of injury, death, financial loss or any other damages incurred as a result of Force Majeure.
Customers engaging in LomiTravels activities are recommended to carry travel insurance that covers medical expenses, personal injury, repatriation and evacuation. Further amendments to your policy, such as trip cancellation, and loss of luggage and personal effect are also encouraged. LomiTravels will not be held liable for lost or stolen luggage.
8. LIMITATION OF LIABILITY
LomiTravels organizes services and holds contracts with a network of companies and organizations to make activities possible. Customers release LomiTravels and its third party contractors from any liability resulting from pain, injury, death, damage or loss of pleasure suffered directly or indirectly as a result of participation in all activities or as a result of LomiTravels or its contractors actions or facilities. Implied warranty is excluded from these Terms and Conditions.
9. CLAIMS AND COMPLAINTS
In the event that a customer has a complaint against LomiTravels, the customer must first file a complaint to the LomiTravels e-mail: firstname.lastname@example.org at the time the complaint arises. The customer waives any complaints if they cannot reasonably demonstrate that the complaint was lodged immediately. The LomiTravels representative is best suited to address customer complaints. If necessary, the representative will contact general manager. If the customer is still unsatisfied then the customer must file a written complaint to LomiTravels within 15 days of the end of the activity. LomiTravels will not accept any liability for claims received after this period.
10. SUPPLIERS’ TERMS AND CONDITIONS
LomiTravels organizes activities and has contracts with agents and suppliers. Customers will be bound by agents’ and suppliers’ own terms and conditions. LomiTravels may supply copies of third-party conditions but makes no guarantee of doing so. The customer may not make the same claim and seek the same recovery against both LomiTravels and its suppliers.
11. ERRORS AND OMISSIONS
These Terms and Conditions have been written in good faith and every effort has been made to accurately reflect LomiTravels policies. LomiTravels cannot be held responsible for any error, omission or unintentional misrepresentation that may appear in this document or on its websites.
LomiTravels may provide personal information to suppliers for the operation of activities and services. LomiTravels will not reveal customers’ personal information to a third party without your explicit approval.

14. UPDATES TO TERMS AND CONDITIONS
LomiTravels reserves the right to update and/or alter these terms and conditions at any time. The client must remain updated with any such changes.
I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE CAREFULLY READ THE ABOVE ACKNOWLEDGEMENT OF RISK, RELEASE AND INDEMNITY. I UNDERSTAND THAT THIS DOCUMENT GOVERNS MY RIGHTS AND LIMITS MY POTENTIAL REMEDIES AND I NEVERTHELESS ACCEPT IT VOLUNTARILY AND KNOWINGLY.
